Limitations of the law on unemployment insurance and improvement suggestions

Currently, social security is an issue of special concern to the State. Job creation and unemployment are among the outstanding welfare issues. In Vietnam, unemployment insurance has the most practical purpose of compensating or replacing part of the income of employees when they lose their jobs, supporting workers to learn a job, maintain their jobs, find jobs based on contributions to the Unemployment Insurance Fund. This is considered a practical solution to help employees soon find jobs and stabilize their lives, thereby reducing the burden on the state budget, contributing to the stability of social security. However, at present, the law on unemployment insurance still has many limitations, adversely affecting the protection of legitimate interests for employees. Based on the analysis, synthesis and evaluation of the provisions of the Law on Employment 2013 and other relevant legal documents, the author learns the limitations of the law on unemployment insurance as well as proposes some measures to overcome these limitations.

Hiện nay, giải quyết việc làm và nạn thất nghiệp là một trong những vấn đề an sinh xã hội quan trọng ở Việt Nam. Trong đó, bảo hiểm thất nghiệp với mục đích là bù đắp hoặc thay thế một phần thu nhập của người lao động khi họ bị mất việc làm, hỗ trợ người lao động học nghề, duy trì việc làm, tìm việc làm trên cơ sở đóng vào Quỹ bảo hiểm thất nghiệp. Đây được coi là giải pháp thiết thực giúp người lao động sớm tìm được việc làm, ổn định cuộc sống, giảm gánh nặng cho ngân sách nhà nước, góp phần ổn định về an sinh xã hội. Tuy nhiên, hiện nay pháp luật về bảo hiểm thất nghiệp, đặc biệt là về trợ cấp thất nghiệp vẫn còn nhiều hạn chế, tác động bất lợi trong việc bảo vệ lợi ích chính đáng cho người lao động. Dựa trên cơ sở phân tích, tổng hợp, đánh giá các quy định của Luật Việc làm 2013 và các văn bản pháp luật khác có liên quan, từ đó tác giả đánh giá những hạn chế của pháp luật về trợ cấp thất nghiệp và đề xuất một số biện pháp khắc phục những hạn chế này.
